The Litigation Department
The
overarching goal of the Litigation Department is to increase access to high
quality legal representation to all Kentuckians. The department will work with existing legal aid
programs in pursuit of this goal.
Complex Litigation Division
This division handles cases involving complex legal issues
(such as employment discrimination, civil rights violations, parental rights,
and consumer protections cases) and complex jurisdictional issues (either in
state or federal court).
The Standard Litigation Division
This division handles what we call “Bread
& Butter” cases - examples of which include (but are not limited to) criminal defense, bankruptcy, family law, consumer protection and federal tax
controversies.
Eligibility for Services
KYPLC seeks to represent individuals and families who are unable to retain legal counsel from another legal aid program or from a private attorney. There are four legal programs in Kentucky that are funded by Legal Services Corporation. Generally, these programs may represent individuals who have household incomes that do not exceed 125% of the Federal Poverty Guidelines. LSC-funded programs are also restricted on the types of cases they may handle. Therefore, KYPLC will represent individuals and families who have gross monthly household incomes
between 126% and 400% of the Federal Poverty Guidelines and issues that can be resolved through the legal process.
Fees
KYPLC will charge clients a nominal fee for services. We believe that this will empower our
clients to fully invest in their representation.
Clients
will be charged on a sliding scale basis – $0.00 up to a one time fee of 10% of
a client’s gross monthly household income. For example, if a client does not have any disposable
monthly income, then s/he will likely not be charged a fee for services.
Both
divisions will seek attorney’s fees where appropriate. Clients may make payment arrangements in order to pay their fees.
Other Activities and Services
KYPLC will accept referrals from other programs who are not able to provide assistance due to lack of resources or funding restrictions. We will also provide support to other programs through co-counseling, training programs, and access to our resource library.
